Smartphone VIP Terms and Conditions

1.1 These terms and conditions shall apply in addition to The Carphone Warehouse terms and conditions available in store and at www.carphonewarehouse.com.

1.2 The Smartphone VIP service is an order for a product which has not yet become available ("Product").

1.3 We hereby acknowledge your interest in the Product and shall endeavour to supply it to you on the Expected Delivery Date subject to the below terms and conditions.

1.4 You shall:

1.41 fulfil all credit checks to our satisfaction;

1.42 successfully pay the required amount to secure the Product (the "Deposit").  This Deposit may only be used as part-payment against the Product, accessories and/or Geek Squad service plans;

1.43 provide a unique e-mail address and a valid telephone number which we can use to contact you to complete the order.  We may also use these details to inform you of other goods or services that may be of interest to you, unless you have opted out of receiving such news.

1.5 The Deposit shall be refunded in the event you fail any credit checks required pursuant to condition 1.4.1.

1.6 The Deposit shall not be refunded in the event you change your mind.

1.7 All orders placed are subject to acceptance by us and the network provider.  We may choose not to accept your order for any reason whatsoever and will not be liable to you or anyone else in those circumstances.

1.8 We will contact you within 48 hours of confirmation of tariff/ pricing options to finalise your order details. In the event we are unable to make contact with you despite repeated and reasonable attempts, we are no longer bound by condition 1.9.

1.9 If you have requested delivery to a nominated address, we shall endeavour to ship the Product to you on the day prior to release in order that you are likely to receive it on the release date (“Expected Delivery Date”). This condition shall not apply in the circumstance outlined at condition 1.8.

1.10 We shall not be liable for any delivery delays beyond our control. Release dates are set by the manufacturers and are subject to change. We shall not be bound by any release dates advertised by us.

1.11 If you have opted for delivery at one of our stores, you will have 7 days from the delivery date to pick up the Product, after which we may cancel your order. Your Deposit shall not be refundable in such circumstances.
